No Doubt filed a lawsuit against Activision, the makers of the popular Band Hero game, last month after apparently taking a dislike to the digital adaptations of themselves playing none No Doubt songs.
The Orange County ska-punks are seeking unspecified damages and an injunction preventing the company from distributing the game. However Activision have decided to counter-sue the band earlier this week, citing “breach of contract” and “unjust enrichment.”
"Activision admits that although it is possible to program a videogame whereby particular in-game characters can only be selected when certain songs are played, [the] Plaintiff first requested this only after the Band Hero programming was finalized, had been submitted to all of the U.S. console manufacturers for approval and had been approved for manufacture by most console manufacturers,” said the company in an official statement.
Activision are requesting unspecified damages and the return of all of No Doubt's royalties stemming from sales of the game.
