Man accused of attacking Madina Lake bassist found not guilty

Justin Pivec, the 35-year-old man accused of brutally assaulting Madina Lake bassist Matthew Leone in 2010, has been found not guilty by a Chicago court.

Leone was left fighting for his life after breaking up a domestic dispute between Pivec and his wife in the West Town area of Chicago in the early hours of June 29, 2010. Police said
Pivec was beating his wife and turned on Leone when he attempted to intervene. Pivec was subsequently arrested and charged on July 2 with with aggravated battery causing great bodily harm.

Leone - who suffered a fractured skull, broken nose and fractured jaw during the attack - was treated at Chicago's University of Illinios Department of Neurosurgery. There, he had one-third of his skull removed to allow the swelling in his brain to go down.

"We're utterly baffled and shocked to get a 'not guilty' verdict in the Justin Pivec attempted murder case," reads a post written by Matthew's brother and vocalist Nathan Leone on Madina Lake's Facebook page. "Admittedly, we're not well versed in the justice system but today a vicious coward was given a free pass for beating his wife and almost killing my brother. This has taken a tremendous toll on all of us for two years and though we're devastated. We will continue to focus on the positive. which is that Matthew is still with us and hopefully this has spread awareness for victims of domestic violence. More later as we attempt to comprehend this."

That's absolutely disgusting. My thoughts are with Matthew and his family - to see someone walk free from something like that must be like a kick in the stomach after everything he's been through.

To be fair to the justice system it's juries who decide whether they are guilty or not so you can't really blame the courts or police. They're must've been some good evidence proving otherwise because most people wouldn't see a woman beating maniac back on the streets.

Also just read it was an attempted murder case. Of course he was found not guilty they should've charged him with whatever America's version of ABH is.

Jack - it was a bench trial, so the judge decided the verdict, not a jury.
It's an absolute travesty. My heart goes out to Matthew and his family.

I agree that our justice system sucks! However even though it is the jury that decides, the judge can still over turn that decision if he sees a reason. Being that it was tried as attempted murder could be why he was found not guilty. Maybe the evidence prove this even though it was obviously a battery case. Either way the fact that this DUCHE bag wasn't heals accountable for his actions is appalling!!! There's always civil court!

I am utterly gobsmacked to see this result. I think that Matthew did a very brave thing that day and paid a huge price for it.

This man is a monster and has basically been given the all clear for his actions. I am totally at a loss as to what to make of this!

All cases don't go before a jury, sometimes it just goes before a judge. This verdict is wrong either way.

That is absolutely shocking! How in the name of God has this thug walked free? He almost killed Matthew for fuck sake!They should have locked the bastard away for life! My heart goes out to Matthew and his family. Karma's a motherfucker though and I'm sure this poor excuse of a man will get his at some point in life.

Not guilty! That's a disgusting verdict jury or no jury. This man is getting away with beating and nearly killing 2 people! My heart goes out to Matthew and his family but also to his poor wife. Let us hope justice is one day served before he can commit another atrocious act such as this.

i have meet all the lads from ML great guys.matthew did something not many would have tried and almost paid the highest cost there is. i would love to know the what grounds the jury in the us had for their finding's. hopefully this bloke will get his what goes around comes around. but nathan is right yeah it is a pain in the ass but ML need to be postive make music and tour

The one good thing out of this story is that they released the guys full name, age, etc therefore all you need is the latest phone book for the Chicargo area as his last name isnt really a dime a dozen so finding out where he lives wouldnt be so hard!!!! Not that im encourging anything like that!!

All the evidence they had pointed to Pivec being guilty. There was police phone recordsings, Hospital reports, pictures of Matthew. Thety even caught Pivec a block away from where it happened. No way he had 'good evidence' for him to get a not guilty. It is absolutley fucking bullshit and if any one tries to say that the judge must of had a reason needs there fucking head sorting out and to have a fucking heart. For god sake.. Matthew flat linned 7 fucking times. FOR GOD SAKE HE FUCKING BEAT MATTHEW TO AN INCH OF HIS LIFE ALL THE EVIDENCE POINTED TO HIM BEING GUILTY. NOW FUCKING STOP SYAING THE JUDGE HAD A GOOD REASON OR MUST OF HAD EVIDENCE 'CAUSE YOU ARE A DICK FOR SAYING THAT.

It should never have gone to court as atempted murder, because theres a lack of malice and hate in the case, matthew approached a fight therefore in the eyes of the law that makes it two sided, it should have been the lesser charge of GBH, (This isnt my personal view just how the justice system "works")
