Following the August news that Nevermind swimming baby Spencer Elden would be suing Nirvana over alleged "child pornography" and exploitation, Dave Grohl has given a brief comment on the situation.

When asked by Vulture what his "stance" on the lawsuit is, Dave responds, "I don’t know that I can speak on it because I haven’t spent too much time thinking about it. I feel the same way most people do in that I have to disagree. That’s all I’ll say."

When it's then pointed out that Spencer has recreated the cover image several times throughout his life (he's now 30 years old), Dave points out: "Listen, he’s got a Nevermind tattoo. I don’t."

Speaking to The Sunday Times earlier this month, the Foo Fighters frontman suggested that legal issues such as this are "par for the course", and in response they might end up updating the Nevermind artwork.

"I have many ideas of how we should alter that cover," Dave said, "but we’ll see what happens."

In the August lawsuit, Spencer sought damages of $150,000 (£109,000) each from 15 different parties involved, including Dave, bassist Krist Novoselic, Hole singer and Kurt Cobain’s widow Courtney Love, and photographer Kirk Weddle.
